what's expected of the buyer
Homeowner’s Insurance
The buyer must obtain a homeowner's insurance policy for the property they
plan to purchase. The policy agent must then call Stewart Title of Tennessee
with the policy information as this information is essential for us to prepare
the final closing figures.
Cashier's Check
A cashier's check is required for any final closing cost. Amounts over $500
should be payable to Stewart Title of Tennessee.
Identification
At closing, the buyer will be asked for some form of identification that discloses
their picture and signature.
Contractual Obligations
The sales contract should contain all agreements between the buyer and seller
and must be signed with any changes initialed by both parties. We will prepare
and conduct the closing only according to the terms agreed upon in the contract.
If possible, it is always best to get any issues resolved before getting to
the closing table.
Miscellaneous
If any party involved in the closing transaction cannot attend the closing,
the lender and title agent must be notified at least three business day prior
to closing. An absent person will be required to execute a "Specific Power
of Attorney" to appoint someone to sign on their behalf in order to allow
the closing to continue without that person being present. This procedure also
requires the approval of the lender.
If anyone involved the closing transaction is in the process of bankruptcy,
divorce or any other court proceedings, the lender and title company must be
notified as soon as possible. These issues could take time to resolve and need
to be handled prior to closing.
