Miscellaneous
If any party involved in the closing transaction cannot attend the closing, the lender and title agent must be notified at least three business day prior to closing. An absent person will be required to execute a "Specific Power of Attorney" to appoint someone to sign on their behalf in order to allow the closing to continue without that person being present. This procedure also requires the approval of the lender.
If anyone involved the closing transaction is in the process of bankruptcy, divorce or any other court proceedings, the lender and title company must be notified as soon as possible. These issues could take time to resolve and need to be handled prior to closing.
